2. Description of Service

NayiPathshala is an AI-powered educational platform designed for Indian students and educators. Our platform provides:

  • AI-generated quiz questions customized to student preferences and curriculum
  • Pre-curated lesson plans and educational content for all grade levels
  • Content aligned with CBSE and State Board curricula
  • Personalized AI-powered feedback on quiz performance
  • Student progress tracking and learning analytics
  • Teacher accounts for content management and student oversight

3. User Accounts and Registration

3.1 Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to create an account. Teachers must be authorized educators to access teacher-specific features.

3.2 Account Types

We offer three types of accounts:

  • Student Accounts: For learners taking quizzes and tracking progress
  • Teacher Accounts: For educators creating content and managing classes
  • Administrator Accounts: For platform management and teacher oversight

3.3 Authentication

Sign-in is provided via Google OAuth. By signing in, you authorize us to access and store your basic Google profile information (name, email, profile picture). Your Google credentials are never stored on our servers.

3.4 Account Security

You are responsible for maintaining the confidentiality of your account. Please notify us immediately of any unauthorized access or security breach.

4. User Roles and Permissions

4.1 Teachers

Teacher accounts have additional permissions including access to student analytics, class management, and oversight of pre-generated educational content. Teachers are responsible for ensuring appropriate use of the platform within their educational context.

4.2 Students

Student accounts can generate personalized quiz questions, attempt quizzes, receive AI-powered feedback, view pre-curated lesson plans, and track personal learning progress. Students under 18 should use the platform under parental or teacher supervision.

5. Acceptable Use Policy

When using NayiPathshala, you agree to:

  • Use the platform for legitimate educational purposes only
  • Not share inappropriate, offensive, or unlawful content
  • Not attempt to circumvent security measures or access restricted areas
  • Not reverse-engineer, decompile, or attempt to extract source code
  • Not use automated tools to scrape or download content in bulk
  • Not impersonate other users or create fake accounts
  • Respect intellectual property rights of all content creators

6. Intellectual Property Rights

6.1 Platform Content

All original content, features, functionality, and design of NayiPathshala are owned by NayiPathshala and protected by international copyright, trademark, and intellectual property laws.

6.2 User Data and Quiz Responses

You retain ownership of your quiz responses, answers, and learning progress data. By using the platform, you grant NayiPathshala a worldwide, non-exclusive, royalty-free license to store and process this data solely to operate the Service, provide feedback, and improve our educational offerings.

6.3 AI-Generated Quiz Content

Quiz questions generated by our AI are provided to you for educational use. The AI generates questions based on your preferences and curriculum selection. You acknowledge that similar questions may be generated for other users based on the same curriculum and preferences.

6.4 Pre-Generated Educational Content

Lesson plans and educational materials provided on the platform are pre-curated using AI (Claude Haiku model) and are owned by NayiPathshala. These materials are provided for your personal educational use and may not be redistributed for commercial purposes.

7. AI-Generated Content Disclaimer

Important: Content, feedback, and recommendations generated by our AI technology are powered by large language models. While we strive for accuracy:

  • AI-generated content may contain errors or inaccuracies
  • Always verify important information before relying on it
  • Use professional judgment when incorporating AI content into educational materials
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content

8. Third-Party Services and Integrations

Our platform integrates with third-party services including:

  • OpenAI API: For AI-powered content generation and feedback
  • Google OAuth: For authentication and user management
  • AWS S3: For secure file storage

Your use of these integrated services is also subject to their respective terms of service and privacy policies.

9. Payment and Subscription Terms

If we offer paid features in the future:

  • All fees are stated in Indian Rupees (INR) unless otherwise specified
  • Subscription fees are non-refundable except as required by law
  • We reserve the right to change pricing with 30 days notice
  • Failure to pay may result in service suspension

10. Data and Privacy

Your use of NayiPathshala is also governed by our Privacy Policy. We collect, use, and protect your data as described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Account Termination and Suspension

11.1 Termination by You

We reserve the right to suspend or terminate your account if you:

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We do not guarantee uninterrupted or error-free service
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount paid by you (if any) in the past 12 months
  • We are not responsible for third-party content or services

13. Indemnification

You agree to indemnify and hold harmless NayiPathshala, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform or violation of these Terms.

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms are governed by the laws of the Republic of India, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

14.3 Arbitration

For disputes exceeding INR 50,000, both parties agree to attempt resolution through binding arbitration under Indian Arbitration and Conciliation Act, 1996.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use of NayiPathshala after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NayiPathshala regarding your use of the platform.
